[ARCHIVED] Donavan Baltzley Found Guilty of Multiple Firearm Related Felonies

Today the jury found 29 year-old Donavan Baltzley guilty of two counts of being a felon in possession of a firearm and two counts of being a felon in possession of ammunition, all felonies.  After the verdict, Mr. Baltzley admitted the special allegation that he had previously served a term in prison.


On February 17, 2018, officers with the Eureka Police Department conducted a traffic stop and found two loaded 9mm firearms in Mr. Batlzey’s vehicle.  The search of his car also revealed evidence of drugs sales and 9mm ammunition in different locations throughout the car.

  

At the time, Mr. Baltzley was on felony probation for his 2016 conviction for Health and Safety Code section 11366.5(a) (allowing a place to be used for the manufacturing, storing or distribution of controlled substances.)  Mr. Baltzley had also been convicted in 2010 for two felony counts of Penal Code section 597(a) (animal cruelty.)  

Deputy District Attorney Whitney Barnes prosecuted the case with assistance from District Attorney Investigator Alan Aubuchon.  The defendant was represented at trial by Attorney Christina Allbright.  Judge Kaleb Cockrum presided over the trial that lasted seven days.  


Mr. Baltzley is scheduled to be sentenced on November 8, 2018.  The maximum sentence he is facing is six years in state prison.
