This week, Blaine Richard Martin received a three-year
prison sentence from Judge Timothy Cissna following his conviction by a jury of
possessing a firearm and ammunition and having previously been convicted of a
felony.
Martin’s
convictions proceed from charges filed by the Humboldt County District
Attorney’s Office after a deputy with the Humboldt County Sheriff’s Office
discovered a loaded .45- caliber semi-automatic handgun and 20 rounds of .45
caliber ammunition on the front seat of Martin’s truck during a routine traffic
stop in March of 2016.
At
the time of this arrest Martin was on formal felony probation after being
convicted in 2015 of possessing a firearm with the intent to commit a
felony. Judge Cissna, finding Martin
violated the terms of his felony probation by committing another
firearm-related felony, also sentenced Martin to serve the remainder of the
prison term that had originally been suspended in his 2015 felony case: Martin
will serve an additional eight months in prison.
It
had been the position of the Humboldt County District Attorney’s Office that
Martin be denied probation for his most recent convictions and that the court
should impose the maximum prison term allotted by statute.
