SB 1421 / AB 748 Information

The Humboldt County Sheriff’s Office has been diligently working to comply with the amendments to the California Public Record Act arising from the passing of Senate Bill No. 1421 and Assembly Bill No. 748.  As a result of the passing of these laws, we are actively engaged in the meticulous review and redaction of thousands of pages of documents, in order to comply with strict privacy, and other laws governing the release of information to the public. This process continues to result in significant demands upon Sheriff’s Office staff. Responsive documents are being released on a rolling basis as they are reviewed and redacted.

Incidents involving the discharge of a firearm at a person by a peace officer. Penal Code 832.7 (b)(1)(A)(i)

Incident in which the use of force resulted in a death, or in great bodily injury. Penal Code 832.7(b)(1)(A)(ii)

Record relating to sustained finding involving a complaint that alleges unreasonable or excessive force. Penal Code 832.7(b)(1)(A)(iii)

Record relating to a sustained finding that an officer failed to intervene against another officer using force that is clearly unreasonable or excessive. Penal Code 832.7(b)(1)(A)(iv)

Record relating to sustained findings of sexual assault involving a member of the public. Penal Code 832.7(b)(1)(B)

Record relating to dishonesty related to reporting, investigation, or prosecution of a crime or directly related to misconduct, including, but not limited to, any sustained finding of perjury, false statements, filing false reports, destruction, falsifying, or concealing of evidence. Penal Code 832.7(b)(1)(C)

Record relating to an incident in which a sustained finding was made by any law enforcement agency or oversight agency that a peace officer or custodial officer engaged in conduct including, but not limited to, verbal statements, writings, online posts, recordings, and gestures, involving prejudice or discrimination against a person on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, or military and veteran status. Record relating to an incident in which a sustained finding was made by any law enforcement agency or oversight agency that the peace officer made an unlawful arrest or conducted an unlawful search. Penal Code 832(b)(1)(E)
