Making a false workers' compensation or automobile insurance claim is a felony. Insurance companies and others report possible fraudulent claims to the California Department of Insurance and that Department then requests investigations by local agencies.
The Humboldt County District Attorney's Office receives grant funding from the California Department of Insurance to investigate and prosecute workers compensation fraud and automobile fraud in Del Norte, Trinity, and Humboldt Counties. Investigations often include collaboration with law enforcement and other local agencies, businesses, and community members.
Workers' compensation fraud includes false claims by individual workers or medical providers, and uninsured employers.
Automobile insurance fraud can include false claims by individuals or staged accidents.
The District Attorney's Office encourages anyone who thinks they have witnessed workers' compensation or auto insurance fraud to report it to the California Department of Insurance. As noted in the California Insurance Code section 1879.5, no person shall be subject to civil liability for filing a good faith report of suspected insurance fraud to the Department of Insurance.
